Juan Miguel: Hi Jason. Can you explain expert witnesses to me? And do I need one to file a lawsuit for my accident?

Jason:  Great question Juan Miguel. An expert witness is a person who testifies because he or she has specialized knowledge about something related to your case. For example, if you were in an automobile accident, you might work with an accident re-constructionist or an accident investigation expert.

Juan Miguel: Oh, I get it, so they look at my case and give their expert opinion on what happened, right?

Jason: Yes. Normally they are called in to help to explain something that is complex or specialized so the jury can understand it better.

Juan Miguel: So how do I know if I should hire one for my accident?

Jason: Juan Miguel, that really depends on the circumstances of your case. My suggestion is that you schedule a consultation with an attorney if you don’t have one already. The attorney should be able to advise you on the steps to take, including whether an expert witness is necessary.

Juan Miguel: I don’t know Jason. Hiring an attorney and an expert witness sounds expensive.

Jason: It doesn’t have to be. Many lawyers will do free consultations. And some will even take on cases without any upfront cost to you. I don’t charge my clients a dime unless we win.

Juan Miguel: Really? You mean that even if we brought in an expert witness, you wouldn’t charge me?

Jason: Correct.

Juan Miguel: That’s great news.

Jason: Yes. But time is often a critical factor in cases where an expert witness is needed. I’ve seen cases where the other party attempts to hide or destroy evidence. The sooner an expert can investigate the better.

Juan Miguel: Thanks Jason! I’m going to get on this right away.
