Rosa: Hi Jason, I keep hearing how important it is to find an attorney with experience, but isn’t it much more expensive to work with that kind? I don’t know that I could afford it.

Jason: This is a great question, Rosa. I’ll answer the part about the benefits of an experienced attorney in a moment, but first let’s talk about the expense. An experienced lawyer with a strong track record of success may actually be your most affordable option.

Rosa: Really? I would think a good attorney would charge much more than someone who is just starting out.

Jason:  Yes, in many professions that is typically how it works – you get what you pay for. But that’s not exactly the case here. In personal injury, attorneys who have experience and a strong track record do not charge you any upfront fees. In fact, I’d be wary of an attorney who does ask you for money up front.

Rosa: You mean I could hire a really good attorney and not have to pay anything?

Jason: Rosa, you wouldn’t have to pay anything upfront. The attorney fees would come out of the total compensation received in your case.

Rosa: But what if we didn’t win? Would I still owe the lawyer money?

Jason:  Before hiring a lawyer, you would want to look at their fee structure for information about this. I personally don’t charge my clients a dime unless we win.

Rosa: Good to know. So then what else matters about experience besides the fees?

Jason:  Well, there are a number of things. To fully develop your case so that it demonstrates the damages you’ve incurred, I recommend that you work with a lawyer who has legal knowledge, resources, and the reputation to handle your case in the best way possible.

Rosa: What do you mean about resources and reputation?

Jason: Well, for example, many of the cases I take on require expert witnesses. Over the years, I’ve established relationships with experts who are highly specialized in their fields – such as medical professionals and accident reconstruction experts.

Rosa: So you know expert witnesses who could help to make my case stronger, whereas a less experienced lawyer may not have these same kinds of contacts.

Jason: Exactly. And as for reputation, the insurance companies know me well. They know I fight to win – and I’ll go to trial before I give in to an unfair settlement. Because of this, they might be more willing to negotiate with me than they would be with a lawyer that they don’t really know. Remember, their goal is to pay as little money as they have to.
