In March 2019, Lori Perez and her 5-year-old daughter, Illiana Martinez, were headed to a doctor’s appointment in Austin, TX. They were passengers in a 2010 Toyota Venza that Lori’s boyfriend, Travis was driving when they were hit by a Dodge truck traveling at speeds above 70 miles an hour. Sadly, they never did make it to the appointment.
Illiana would see a doctor that day. In fact, she would see numerous doctors, nurses and hospital workers who tried desperately to save her life. But in the end, they just couldn’t save her.
Her family mourned the loss of their beloved little girl on April 6th at a service held at Rosas Funeral Home in Alice, TX.
While nothing could be more tragic than the loss of a loved one – especially a young, innocent life, tragedy would continue for Illiana’s family. You see, the man driving the Dodge truck who hit Illiana and her mother, fled the scene the day of the accident. He and his two passengers were spotted by witnesses getting out of the truck and running away.
It took nearly a month for the police to find 22-year-old Jorge Granado, the man who caused Illiana’s tragic death. Granado was located in Slidell, Louisiana and brought back to Texas to face multiple charges related to the accident.
But the relief of finding Granado would be short-lived for Lori Perez, Illiana’s mother.
The grief-stricken mother filed a claim of “mental anguish” with Farmers Insurance, her auto insurance provider. Despite the fact that Lori lost her five-year-old daughter, Farmers denied her claim.
Let that sink in. Farmers Insurance refused to accept a mother’s claim of “mental anguish” on her own coverage after her little girl was killed by a hit-and-run driver.
And to make matters worse, the municipal prosecutor in Austin has decided to pursue charges against Lori’s boyfriend, Travis, who was driving the car that was struck by Jorge Granado. Travis is charged with failure to yield at a stop sign, even though Lori confirmed with the police that he did nothing wrong.
Fortunately, Lori is working with injury attorney Jason DeSouza. With compassion and care, he is helping Lori to understand her rights and fight for the compensation she deserves. He knows that this isn’t just about money, but about helping a mom through the most difficult time of her life.
