Joe: Hi Jason. My cousin was in an accident last week with this guy in a big truck. It messed up his car pretty bad and he had to go to the hospital. He’s out and doing okay, but still not back to work. I told him he should see a lawyer to see if he had a case. He asked what all he could sue for. Do you know?

Jason:  Hi Joe, I’m sorry to hear about your cousin’s accident. It sounds like it was a bad one. I’m glad he’s doing better, but I hope he takes your advice and talks to a lawyer soon, especially if the accident wasn’t his fault. Depending on the details of his case, there are a number of damages he could seek compensation for.

Joe: That’s what I thought. I just didn’t know what they were. Can you tell me so I can tell him?

Jason:  Well, Joe, based on the information you’ve shared with me, I’d say that medical treatment is one of the damages that he could pursue. This covers the cost of any medical care he’s needed because of the accident. This includes reimbursement for any bills he’s already received for treatment plus the estimated cost of future medical expenses.

Joe: Oh, that’s good to know. What about his car?

Jason: It’s possible that your cousin could seek compensation for property loss if his car or any other property was damaged in the accident. How much money he could seek for property loss damages would be based on the cost of repairs or fair market value of anything that was lost. Has he been out of work since the accident?

Joe: Yes, he broke a few bones, including in his right hand so he can’t do his job right now.

Jason:  Then he might be able to sue for lost wages and loss of earning capacity too. Lost wages cover money that he’s lost while recovering from the accident. And loss of earning capacity is based on future income if his injuries keep him out of work for a while.

Joe:  Wow, so it sounds like he could really get some help financially for all that’s happened.

Jason: If it is determined that the other party was at fault for the accident, then yes, your cousin could seek these damages and possibly others as well, like pain and suffering. These are some of the more common ones, and what he can get depends on the facts of his case.

Joe: Oh that is really good news!

Jason: Yes, but please encourage him to speak with a lawyer soon. The longer he waits, the more difficult it could be to prove his case and get a fair compensation.
