Mario: Hi Jason, my son was in San Antonio, and he got in an accident on one of those e-scooters. He said the handlebar just collapsed on him! Now he’s got broken bones and all kinds of injuries, but since he wasn’t hit by anyone, who can we sue?

Jason: Thank you for your question, Mario. I’m sorry to hear about your son’s accident. From what you’ve told me, it sounds like an e-scooter malfunction. If so, you could sue the manufacturer.

Mario: Oh that is good news. Like I said, he has a lot of injuries, and I am really worried about how we can pay for all these medical bills.

Jason: Was he wearing a helmet at the time of the accident?

Mario: No he didn’t have one on, but I don’t think he was required to. We know that he hit his head, but not sure how much damage he did. He’s had a lot of headaches.

Jason: Your son could have a traumatic brain injury. Sometimes symptoms show up immediately, but it can also take weeks to know the extent of his injuries. I’d be happy to take a look at your case, Mario.

Mario: Thank you, Jason. Is it expensive to work with you?

Jason: I don’t charge anything upfront – you only owe me if we settle or win your case.

Mario: Okay. So how do we prove what happened? I mean, he was taken to the ER and I’m guessing by now the area is all cleaned up.

Jason: That’s okay, Mario. There are still plenty of ways to build a case. We can request a copy of the police report, medical records from the ambulance and ER, and even video camera footage if any surveillance cameras caught it. If someone called for an ambulance, then we may be able to collect eyewitness accounts.

Mario: What if the e-scooter company tries to say the accident was his fault even though the handlebar collapsed?

Jason: That’s possible, Mario. These big companies don’t want to pay anything that they don’t have to. So it is likely that that this company will fight it. It’s important to start building the case as soon as possible so we can prove your son’s injuries are a result of the accident.

Mario: I’ll talk to my wife, and then we will give you a call.

Jason: Sounds good, Mario. Feel free to call me on my personal cell at 210-591-9777.

Mario: Thank you, Jason.
